Texas operator changes

Look the lease up by the name on your royalty stub. Every lease page lists each operator that reported it, with the first and last month of each. A change in the last 24 months is also flagged in the results below when you pick your county.

It puts a new company in charge of paying you. Under Natural Resources Code section 91.407 the new payor must give you written notice, within the time it has to pay, with the property name and number, the sales month, an address and phone number for questions, and a description of the property. Your lease and your decimal do not change because of the switch alone, but the months on either side of it are where a payment can be missed.

What to do after an operator change

The company that pays royalty is the payor, and it is usually the operator of the lease. When a lease is sold or the operator changes, the payor changes with it. The state record shows the month the new operator first reported the lease, which is the best guide to when your payor changed.

The record shows who reports a lease, not who owns the minerals or the working interest, so a sale that keeps the same operator does not appear.

Often, yes. A payor may require a signed division order as a condition of payment if it contains only the provisions listed in section 91.402(c). If it contains extra provisions and you refuse to sign, the payor may not withhold payment solely because of that.
